Transfers of Leave Balances with Continuous City Service

Transfers In 

The DOE will accept limited leave balances upon the appointment of an employee who has continuous service in another City of New York agency from an eligible list or is appointed to a position in a classified civil service title, upon submission of an appropriate substantiating statement to the Division of Human Resources. 

The maximum leave balances accepted by the agency upon certification by the Division of Human Resources (unless otherwise stipulated in any collective bargaining agreement or otherwise authorized) are:

  1. Up to 2 (two) years accrued annual leave; and
  2. All sick leave balances.

The agency will not accept any compensatory time balances (including blood comp time), or the Floating Holiday credited to eligible employees for Lincoln’s Birthday.

Transfers Out

Employees who accept employment with another City of New York agency should confirm what that agency’s specific policy is concerning the transfer of accrued leave balances before they accept the position. Each City agency determines how much accrued leave they will accept from employees who transfer in from other City agencies.

It is the policy of the DOE that it will pay the employee for any leave balances that are not accepted as part of the transfer. The calculation of the payout for these leave balances would be the same as if the employee were retiring from DOE service, and is based on the employee’s title, years of service, and collective bargaining unit at the time of the transfer out. Policies governing the payout of leave balances are Chancellor’s Regulations, Comptroller’s Directives, Rules and Regulations for Administrative Employees, and Collective Bargaining Agreements. 

NOTE: Continuous service is defined as service which has not been interrupted by a break of thirty-one calendar days or more, unless otherwise stipulated by law or collective bargaining agreement.
