Overview
Per Chancellor’s Regulation C-105, any person employed by or providing services (including vendors, contractors, consultants, and volunteers) to the Department of Education who has been arrested and charged with a felony, misdemeanor, or violation must immediately notify the Office of Personnel Investigation (OPI) and their supervisor in writing and provide a copy of the criminal court complaint.
Notification to the supervisor alone does not satisfy this reporting requirement. The Office of Personnel Investigation (OPI) must be notified separately in writing, by sending an email to OPIarrestnotification@schools.nyc.gov. Failure to notify OPI and the employee’s supervisor of an arrest may result in disciplinary action. This requirement remains in effect when employees are on an approved leave of absence at the time of the arrest.
Reassignment/Suspension/Restriction of Duties
When warranted by the nature of the arrest, the agency may direct that an employee be temporarily removed from their duties and responsibilities, restricted from performing certain aspects of their job responsibilities, or they may be suspended without pay. An employee’s refusal to accept and report to a reassignment or follow a suspension directive pending the disposition of an arrest may result in disciplinary action.
Disposition of Arrest
Upon final disposition of any criminal charges, the employee/vendor/contractor/consultant must provide the Office of Personnel Investigation with an original certificate of disposition within three (3) business days of the resolution of the case.
Failure to submit a written disposition in a timely manner may result in additional actions impacting the person’s eligibility to work.
The final disposition will be reviewed along with available information from law enforcement and prosecutorial agencies, as appropriate, and if necessary, a disciplinary recommendation will be forwarded to the appropriate division head.
